Sherburn man charged with bigamy is remanded
AT NORTON (Malton) police court on Tuesday, Edward Donald Rigby, described as a labourer, of Sherburn, was brought up on remand charged with bigamously marrying Ada Mary Bell, his former wife, Esther Mary being still alive.
Superintendent Nicholson asked for a further remand for eight days.
Mr AEB Soulby, solicitor, of Malton, who appeared for the defence, said that this was the third time that Rigby had been brought before the bench, and if the prosecution were still unable to prove the case it ought to be withdrawn.
The deputy magistrate's clerk (Mr W Hall) said that the application of the prosecution for the further adjournment was only made so that the
case might be brought fully before the court to see if a prima facie case could be made out in order to allow the case to go to quarter sessions.
Esther Mary Rigby was called.
The deputy magistrate's clerk was proceeding to question her when Mr Soulby objected.
Mr Hall: But I must get to know if she is Rigby's wife.
Witness, in answer to Mr Hall, said she was the accused man's wife.
Mr Soulby: I object to her being sworn.
Mr Hall admitted that Mr Soulby was perfectly in order in objecting.
The magistrate: Mr Soulby objects on the ground that if the witness is the first wife of the man Rigby she is not able to give evidence against her husband.
Mr Hall: That is so.
Witness was not sworn, and Mr Metcalfe, granting the superintendent's request, an eight days remand was agreed to.
