Benefit of doubt over milk business owner

William Petch Lyth (90) Commercial Street, appeared on two adjourned charges for having sold to James Bastiman, inspector of Foods and Drugs, a pint of new milk which was not of the nature, substance, and quality demanded on May 25th. The cases were adjourned from Friday when defendant alleged that the business was not his, but his daughters.

Defendant, cross-examined by Mr Jones, state that the business had been his daughter's for a year.

Miss Lyth said that her father had made over the business to her some time before Christmas, and that she had entire control over it since.

PC.Welburn stated that he has seen Mr Lyth in four different streets carrying milk cans, but he could not say whether he sold milk or not.

Lyth admitted the cans, but stated that he very seldom sold a drop of milk.

The magistrate retired, and on returning into court the Chairman (Dr Horne) said the case was a suspicious one, but the magistrates would give the defendant the benefit of the doubt. The daughter had made a mistake in not having herself registered as a milk seller when the business was made over, and had rendered herself liable to be prosecuted.

Mr Lyth wished to explain the reason for this but was not allowed.
